Texas BUI Penalties You’re Facing

Boating While Intoxicated is defined under Texas Penal Code Section 49.06 as operating a watercraft while intoxicated. The penalty tier depends on your history and the circumstances of the charge.

Penalty levels by offense:
  • First offense (Class B misdemeanor): Up to $2,000 in fines and between 72 hours and 180 days in jail
  • First offense with BAC of 0.15 or higher (Class A misdemeanor): Up to $4,000 in fines and up to one year in jail
  • Second offense (Class A misdemeanor): Up to $4,000 in fines and up to one year in jail. A prior DWI counts as a prior offense.
  • Third offense (third-degree felony): Up to $10,000 in fines and two to ten years in prison
  • Intoxication assault: Serious bodily injury to another person elevates the charge to a third-degree felony: two to 10 years in prison and up to $10,000 in fines
  • Intoxication manslaughter: Causing a death elevates the charge to a second-degree felony: two to 20 years in prison and up to $10,000 in fines

A conviction can also result in a driver’s license suspension of 30 days to two years. Refusing a breath or blood test after arrest triggers an automatic 180-day suspension under Texas’s implied consent law, entirely separate from the criminal case. How BWI Enforcement Differs from DWI

One of the most important distinctions between a DWI and a BWI is how officers can initiate contact. Under Texas Parks and Wildlife Code Section 31.124, law enforcement can stop and board any vessel at any time to conduct a safety inspection. No probable cause or reasonable suspicion is required.

On land, a traffic stop requires legal justification. On the water, it doesn’t. During a routine safety check on Lake Ray Hubbard or Lake Lewisville, if officers observe signs of intoxication, they can immediately pivot to a BWI investigation. It’s also worth knowing that open containers are legal on a boat in Texas for passengers. Only the operator commits an offense by being intoxicated while operating the vessel.

To secure a BWI conviction, the prosecution must prove three things: that you were intoxicated, that you were operating the vessel, and that the device qualifies as a watercraft under Texas law. Each element can be challenged.

  • Field sobriety test reliability: Balance impairment from time spent on water can mimic signs of intoxication, and results may be challengeable if officers didn’t allow adequate time ashore before testing
  • Breathalyzer calibration: Device maintenance records and officer training are subject to scrutiny
  • Operator identity: If law enforcement misidentified who was actually operating the vessel, that is a viable defense
  • Prescription or OTC medications: The state must prove impairment of mental or physical faculties, not just a BAC reading
