Auto Theft vs. Unauthorized Use of a Motor Vehicle
Texas law doesn’t treat every unauthorized vehicle case as the same offense. Under Texas Penal Code Section 31.03, theft involves unlawfully appropriating property, meaning acquiring or exercising control over it, with intent to deprive the owner of that property.
Texas Penal Code Section 31.07 addresses unauthorized use of a motor vehicle. The offense requires proof that someone intentionally or knowingly operated another person’s motor-propelled vehicle without the owner’s effective consent, meaning legally valid permission. It is classified as a state jail felony.
