What Constitutes Aggravated Assault Under Texas Law

Texas Penal Code §22.02 defines aggravated assault through two distinct paths. The first is causing serious bodily injury to another person intentionally, knowingly, or recklessly. The second is using or exhibiting a deadly weapon during the commission of any assault. Both routes lead to the same felony charge, but the evidence the prosecution must prove differs significantly between them.

Serious bodily injury means an injury that creates a substantial risk of death, permanent disfigurement, or protracted loss or impairment of a body part or organ. Broken bones, stab wounds, and traumatic brain injuries commonly meet this threshold, though the determination isn’t always straightforward. A deadly weapon isn’t limited to firearms. Courts have classified vehicles, bats, bottles, and even bare hands as deadly weapons based on how they were used.

One important distinction from simple assault: no physical injury needs to occur under the deadly weapon path. Displaying a firearm while making a threat can be enough to support the charge. Simple assault under §22.01 is typically a Class A misdemeanor. Aggravated assault under §22.02 is always a felony, with consequences that extend well beyond the sentence itself.
